Pursuant to the Arizona State Constitution, the Town of Duncan as authorized by Resolution No. 24-04 passed on March 13, 2024 by a unanimous vote of the council, will seek voter approval to permanently adjust the 1979-80 expenditure limitation base amount of the Town as determined by the Economic Estimates Commission. 


With voter approval, the Town will permanently increase the 1979-80 expenditure limitation base amount by $500,000 beginning in Fiscal Year 2025/26. The Town will utilize the additional expenditure authority for any local budgetary purposes including streets, police, fire, parks, recreation, wastewater, solid waste collection, and similar municipal services. 


Voter authorization for the permanent adjustment of the State-imposed expenditure 
limitation base will appear on the Primary Election ballot on July 30, 2024.

PROPOSED CDBG PROJECTS

The Town of Duncan is expected to receive $100,000 in FY 2025 CDBG funds from the Arizona Department of Housing Regional Account (RA). The Town also intends to apply for up to $1.9 million in Colonias Set Aside CDBG account Funds. CDBG funds must be used to benefit low-income persons and areas, alleviate slum and blight or address urgent need. Based on citizen input as well as local and state planning objectives, potential projects will be selected to be forwarded to the State of Arizona with a request for funding. A public hearing will be held at a Council meeting on February, 8th 2024 at 4:00 pm inside Duncan Town Hall, 506 SE Old Hwy Duncan, AZ 85534, to discuss the potential projects. It is expected that the Council will select two projects at this hearing, 1 Regional Account and 1 Colonias CDBG project and adopt applicable resolutions. The potential CDBG projects are as follows:

Safety issues regarding the park in town
Lighting for the park in town
Housing rehab
Handicap accessible parks
Water and Wastewater improvements

ORDINANCE NO. 24-01

 AN ORDINANCE OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF DUNCAN, GREENLEE COUNTY, ARIZONA ADOPTING THE “TOWN OF DUNCAN BACKFLOW PREVENTION AND CROSS-CONNECTION CONTROL POLICY” BY REFERENCE TO AMEND ARTICLE 16-13 OF THE TOWN OF DUNCAN CODE AND PROVIDING FOR SEVERABILITY AND THE EFFECTIVE DATE THEREOF.

          WHEREAS, the Town of Duncan owns and operates its public water supply system and has established a policy to prevent backflow contamination and pollutants into the public water system to protect the public water supply of the Town; and
          WHEREAS, the Mayor and Council of the Town of Duncan believe, after consultation with its staff, that amending Article 16-13 of the Town Code to update the backflow prevention and cross-connection control policy would be in the best interest of the Town of Duncan; and
          WHEREAS, A.R.S. §9-802allows a Town to adopt a public record by Ordinance as a means to reduce publication costs while ensuring that the public gets fair notice and opportunity to review its operative provisions.
          NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF DUNCAN, ARIZONA, AS FOLLOWS:
           SECTION 1. That certain document filed with the Town Clerk and entitled “Town of Duncan Backflow Prevention and Cross-Connection Control Policy” as set forth in Exhibit A, attached hereto and incorporated herein by reference, is hereby declared a public record.  One paper copy and one electronic copy of Exhibit A shall be maintained in compliance with A.R.S. § 44-7041 and available for public inspection during normal business hours in the Office of the Town Clerk and shall be available on the Town’s website at: www.duncanaz.us.
           SECTION 2.  Article 16-13: Cross-Connection Control Program of the Duncan Town Code is hereby repealed in its entirety and replaced with the provisions as set forth in Exhibit A, and that the amendments depicted therein are hereby approved and adopted.
           SECTION 3.  The following penalty provisions are included in Section 16-13-13 of that certain document known as “Town of Duncan Backflow Prevention and Cross-Connection Control Policy”:
           A. Any person, firm, corporation, partnership, enterprise, or association, whether as principle, owner, agent tenant, or otherwise who violates, disobeys, omits, or refuses to comply with, or who resists the enforcement of the provisions of this Article shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed $2500.00 or by imprisonment for a period not to exceed 6 months, or by both such fine and imprisonment.
           B. Each Day any violation of any provision of this Article occurs shall constitute a separate offense.
           SECTION 4. To the extent of any conflict between other Town Ordinances and this Ordinance, this Ordinance shall be deemed to be controlling; provided, however, that this Ordinance is not intended to amend or repeal any existing Town Ordinance, Resolution or regulation except as expressly set forth herein.
           SECTION 5.  If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
           SECTION 6.  This Ordinance shall become effective thirty (30) days from the date of adoption by the Town Council for the Town of Duncan.

Public Hearing Regarding Use of CDBG Funds

The Town/City/County is expected to receive approximately $100,000 in FY2024 federal CDBG funds from the Arizona Department of Housing Regional Account (RA).  Elevated Fluoride Levels Detected

This is an alert about your drinking water and a cosmetic dental problem that might affect children under nine years of age. At low levels, fluoride can help prevent cavities, but children drinking water containing more than 2 milligrams per liter (mg/l) of fluoride may develop cosmetic discoloration of their permanent teeth (dental fluorosis). The drinking water provided by your community water system Town of Duncan has a fluoride concentration of 2.1 mg/l.

Dental fluorosis in its moderate or severe forms, may result in a brown staining and or pitting of the permanent teeth. This problem occurs only in developing teeth, before they erupt from the gums. Children under nine should be provided with alternative sources of drinking water or water that has been treated to remove the fluoride to avoid the possibility of staining and pitting of their permanent teeth. You may also want to contact your dentist about proper use by young children of fluoride-containing products. Older children and adults may safely drink the water.

Drinking water containing more than 4 mg/l of fluoride (the U.S. Environmental Protection Agency’s drinking water standard) can increase your risk of developing bone disease. Your drinking water does not contain more than 4 mg/l of fluoride, but we’re required to notify you when we discover that the fluoride levels in your drinking water exceed 2 mg/l because of this cosmetic dental problem.

  • Housing: older citizens, many houses that can be used for those who cannot live in their own homes any longer

  • Fire hydrants.
  • Duncan theater – tear down and turn around – declare area slum and blight.
